1. IDENTIFICATION OF THE SERVICE PROVIDER

This document sets out the general terms and conditions of use for the website and the services offered by AI Spots Tech, a brand operated by REMOTION, S.L., with registered office at C/ Bristol 6, 4ºC, 28028 Madrid, VAT:B72668478, registered in the Madrid Commercial Registry. 2. PURPOSE OF THE SERVICE

AI Spots Tech is a SaaS platform that allows users to generate, customize, and download advertising audio using artificial intelligence technology. Users can generate audio using tools from OpenAI (for scripts), Eleven Labs (for voice cloning), and Sumo (for music), all in an automated manner.

3. CONDITIONS OF USE OF THE PLATFORM

Access to and use of AI Spots Tech is subject to acceptance of these terms and conditions. By using the platform, the user declares that:

• They are over 18 years of age and have the legal capacity to contract.

• They will use the platform in accordance with applicable law and these terms.

• They will not use the platform to generate content that infringes third-party rights, laws, or regulations.

4. ASSIGNMENT OF RIGHTS OVER GENERATED AUDIO

Users who generate and download audio through AI Spots Tech will receive all rights of use, reproduction, distribution, and commercial exploitation without restrictions. AI Spots Tech does not retain any rights over audio files downloaded by users.

5. LIABILITY FOR USER-GENERATED CONTENT

AI Spots Tech provides the technology to generate audio but is not responsible for the content created by users. The user assumes full responsibility for the use of the audio, including but not limited to:

• Use of offensive, discriminatory, or defamatory language.

• Content that infringes third-party intellectual property rights.

• Illegal content or content contrary to morality and public order.

In the event of receiving notifications of legal infringements, AI Spots Tech reserves the right to suspend or block access to the platform.

6. PURCHASE PROCESS AND DELIVERY OF AUDIO

• Once payment has been made, the user may generate and download their audio through the platform.

• Audio files are delivered in .mp3 format, ready for use.

• AI Spots Tech will not deliver files once generated, so it is recommended to make backup copies.

7. REFUND AND CANCELLATION POLICY

• If the generated audio is not downloaded correctly, the user may regenerate it at no additional cost or request a refund by writing to support@aispots.ai within 7 calendar days from the date of the failed download.

• No returns will be accepted once the user has downloaded the audio, except in the event of a system failure that prevents its proper use.

8. LIMITATION OF LIABILITY

AI Spots Tech shall not be liable for:

• Technical problems beyond the platform's control.

• Improper use of audio by the user.

• Economic losses arising from the use of the platform.

9. MODIFICATIONS TO THE TERMS AND CONDITIONS

AI Spots Tech may modify these terms at any time. Users will be notified via the website and/or email.

10. APPLICABLE LAW AND JURISDICTION

These terms are governed by Spanish law. Any dispute will be resolved by the Courts and Tribunals of Madrid.
